In a recent memo regarding lawful and unlawful rules for employee conduct, the National Labor Relations Board general counsel noted that: “Employees have a right under the NLRA to argue and debate with each other about: the union; management; and their employment terms and conditions. Employees' Section 7 discussions do not lose their protection even if they include ‘intemperate, abusive and inaccurate statements.’”
