Circuit Court of Appeals has largely upheld the analysis found in the Board's decision in Browning‐Ferris . See Browning‐Ferris Indus. of Cal., Inc. v. NLRB , No. 16‐1028 (D.C. Cir. Dec. 28, 2018). The National Labor Relations Board is currently engaged in rulemaking on this topic.
