Marking the latest but far from the last chapter in the ongoing controversy over determination of joint employment status, the D.C. Circuit Court of Appeals has largely upheld the analysis found in the Board's decision in Browning‐Ferris . See Browning‐Ferris Indus. of Cal., Inc. v. NLRB , No. 16‐1028 (D.C. Cir. Dec. 28, 2018). The National Labor Relations Board is currently engaged in rulemaking on this topic.
