Many employees have smartphones that can produce both audio and video recordings. Without a policy on the subject, employees will make surreptitious recordings with their phones, which can be used as evidence against the company in support of unfair labor practice charges. The question is can an employer enforce a policy that prohibits employees from recording conversations at work unless those being recorded consent to the recording?
