Employers must be very careful and should be guided by counsel when talking with employees during a campaign about what will happen to their wages if the union wins or loses. It is lawful for the employer to explain that wages could go up or down if the union is elected. It is even lawful to predict what might happen to wages if the company was unionized—just so long as such predictions are rooted in demonstrable numerical data about the business. It is unlawful to imply a promise of a wage increase if employees vote against joining the union.
