The following case, Enterprise Leasing Co. of Fla., LLC v. NLRB (D.C. Cir., No. 15‐1200, 8/5/16), serves as an important reminder that the National Labor Relations Board enforces extremely strict rules on employer communications and actions during a decertification effort. All managers and supervisors, therefore, should be fully trained on permissible communications during the course of either employees' attempts to file decertification petitions to obtain an election or during an election campaign itself.
