The National Labor Relations Board has found unlawful Schwan Food Company work rules that, among other things, prohibited employees from disclosing information concerning employees, discussing the company's business with third parties, and using the company's name in any “publication” without permission. Also unlawful were work rules prohibiting the disclosure of customer information and requiring avoidance of “conduct on or off duty which is detrimental to the best interest of the company” A noncompete and confidentiality agreement that prohibited employees from discussing “wages, commissions, performance, or identity of employees” was unlawful as well ( Schwan's Home Service, Inc. , 364 NLRB No. 20 (2016)).
