You might think the National Labor Relations Board would have no authority to rule on the legality of an employer's decision to give its nonunion employees a raise, but you would be wrong. The Board recently held that increasing the wages of nonunion employees to the exclusion of employees who had recently elected union representation constitutes an unfair labor practice ( KAG‐West , 362 NLRB No. 121 (2015)).
