This National Labor Relations Board has again ruled that a mandatory arbitration agreement violates the law, Acevedo v. Amex Card Servs. Co. , Case No. 28‐CA‐123865; 363 NLRB No. 40 (Nov. 10, 2015). As with employee handbooks, this is another area where employers who don't have unions or union campaigns are exposed to second‐guessing by the Board.
