“Common sense sometimes matters in resolving legal disputes. This case is a good example.” Those are the statements with which the District of Columbia Circuit Court of Appeals began a recent decision. It decided that the National Labor Relations Board was wrong in a case concerning whether AT&T workers had a right to wear T‐shirts critical of the company while servicing customers.
