According to a new ruling by a National Labor Relations Board administrative law judge (ALJ), Macy's maintains unlawful policies on the confidentiality of work‐related information, employee contacts with government agencies, and employees' use of the company's logo. The unlawful rules are not remedied by a savings clause the company added seven months after the unlawful rules were originally distributed ( Macy's, Inc. , No. 1‐CA‐123640, 5/12/15). The case cautions nonunion employers about both the risk of maintaining unlawful rules and the requirements for a valid savings clause.
