Questioning employees about whether they support a union is illegal. If you are facing union organizing activity, even asking people about their complaints is often illegal. But HR asking an employee how she feels about her supervisor when there isn't even a union campaign under way? Until recently, that might have been no problem. After all, HR is supposed to keep tabs on employees' performance. But when HR at a private, for‐profit university asked an employee how she felt about a certain supervisor and the employee volunteered that coworkers have problems with this supervisor, the HR staffer committed an unfair labor practice (ULP) when she asked the worker which of her coworkers had problems with the supervisor ( Grand Canyon Education , 359 NLRB No. 164 (2013))!
