The National Labor Relations Board relied on a “faulty premise” when it ruled unlawful an employer's policy that employees while working could wear only their employer‐provided baseball caps, according to a recent ruling by the US Court of Appeals for the District of Columbia Circuit (World Color(USA) Corp v. NLRB, D.C. Cir., No. 14‐1028, 1/16/15).
