Legislation in New Zealand dealing with Maori land, though well intentioned, has given rise to the twin problems of alienation and fragmentation. Legislation proposed by the Aboriginal Land Rights Commission for the Northern Territory of Australia basically avoids these pitfalls, but there are some clauses that could give rise to some forms of alienation and fragmentation.
