Recently, the U.S. Environmental Protection Agency (USEPA) published a regulation that clarifies when a discharge permit is required under the Clean Water Act (CWA) for trans‐basin water transfers. This article discusses the question of whether a National Pollutant Discharge Elimination System (NPDES) permit is required because the movement of surface water from one basin to another to serve municipal, agricultural, and commercial needs may also result in the movement of pollutants from one water body to another.
