According to a Minnesota appellate court, the Minnesota Pollution Control Agency's (MPCA's) use of its phosphorus strategy, which suggests a minimum water residence time of 14 days before a body of water is deemed a lake or reservoir for purposes of phosphorus control rules, was not arbitrary or capricious.
