The Supreme Court of Idaho has ruled that a junior water appropriator could defeat a senior appropriator's resumption‐of‐use defense to a statutory forfeiture of water rights only by establishing that the junior appropriator had used the available water for a beneficial purpose after the statutory period of nonuse.
