The US Court of Appeals for the Eighth Circuit has ruled that claims for civil penalties brought by environmental groups under the citizen suit provisions of the Clean Water Act (CWA) were rendered moot by the issuance of National Pollutant Discharge Elimination System (NPDES) permits by the Minnesota Pollution Control Agency (MPCA).
