The Montana Department of Natural Resources and Conservation could not issue water permits on a Native American reservation until the rights of a group of tribes had been quantified, according to the Supreme Court of Montana. In this case, a confederation of Native American tribes petitioned the Montana Supreme Court, seeking to enjoin the department from issuing water use permits on Native American reservations until the water rights of the reservations' tribes had been quantified.
