In a matter of first impression, the Commonwealth Court of Pennsylvania ruled that under the State Bituminous Mine Subsidence and Land Conservation Act as amended, the Department of Environmental Protection had to require the operator of a mine seeking a renewal permit to make an actual determination of how a water supply would be replaced.
