Southwest Metropolitan Water and Sanitary District and the Platte Canyon Water and Sanitary District both have utility lines located in public rights‐of‐way along streets in Jefferson County. The county decided to conduct two road improvement projects that would require relocation of the utility lines because of alterations in the grade elevation of the roads. Both districts refused to relocate their lines or to bear the cost of relocation. The county sued, seeking a declaration that the utilities had to bear the cost. The trial court and court of appeals ruled for the county.
