The US Fish and Wildlife Service (USFWS) owned and operated a wildlife refuge in South Dakota established in 1935. In 1971, the USFWS bought 6,665 acres of a ranch contiguous to the refuge. The ranch land was used for a shallow‐water habitat for migratory waterfowl. USFWS applied for three water permits from the state Water Management Board. The second permit was for a new water right to the natural flow of water from six springs near a lake. This water was to be used to maintain 235 acres of marshes, sloughs, and wet meadows for the wildlife habitat. Surrounding landowners appealed the board's decision. The trial court affirmed the second permit.
