The City of Round Rock, Texas, obtained water from the Brazos River Authority and sold and distributed the water to its inhabitants. The city also furnished water to the Brushy Creek Municipal Utility District under a 1986 contract. Wishing to be relieved of the contract fees and charges, the city in 1991 asked the Texas Water Commission (TWC) to revise the contract by substituting rates fixed by the TWC for the fees and charges stated in the contract. The TWC granted the relief requested by the city. The utility district appealed, claiming the TWC had no power to take such action.
