Since 1975, the Tonto Creek Estates Homeowners Association (TCEHA) operated, maintained, and fully controlled a water system serving Tonto Creek Estates. The TCEHA established a policy that any water it furnished would be for interior domestic use only. Several owners of lots in Tonto Rim Ranch, a subdivision abutting Tonto Creek Estates, applied for service from the water system. Because the lot owners had not yet built homes, they could not make any interior domestic use of water. Thus, the TCEHA denied service. An owner who was denied service filed a complaint with the Corporation Commission. A commission order that the water system provide nondiscriminatory water services to Tonto Rim Ranch was upheld by the trial court.
