This case involves the competition between reuse and potable water service to an industry. The city of Bisbee, Arizona, processed sewage through a wastewater treatment plant in the service area of Arizona Water Company (AWC). The city contracted to deliver 100,000 to 300,000 gallons of sewage effluent per day to a copper‐leaching operation. AWC demanded the city cease “providing water service” within AWC's service area. The city refused. AWC sought a declaration that it had exclusive service rights in the area and damages for the alleged taking of its property without just compensation. The trial court ruled against AWC.
