George W. Hatchard owned commercial property that consisted of an office building, a parking lot, and a wetlands area. A family care center was one of the building's tenants. In May 1985, Hatchard filled 5,400 sq ft of wetlands on the property to create an additional parking lot for the care center. The Army Corps of Engineers notified Hatchard this was illegal without a permit. Hatchard applied for an after‐the‐fact federal permit from the Corps, which was denied. Hatchard was directed to remove the fill and restore the area to its previous condition. His attempt to obtain a state permit from the Environmental Hearing Board (EHB) was also unsuccessful.
