In Florida a dispute arose between JJ's Mobile Homes Inc., a private utility authorized by the state Public Service Commission (PSC) to provide utilities in a certain territory, and the City of Mount Dora, which subsequently annexed that territory and then claimed the right to provide similar services. By ordinance, the city approved a land developer's proposal that the municipality serve the developer by extending its water and sewer utilities into a part of the annexed area. JJ's sought a judicial determination that it had the exclusive right to provide the services. The trial court ruled for JJ's.
