The Supreme Court of Nebraska has upheld the constitutionality of a state law that allows the undiverted application of a natural stream for recreational or fish and wildlife purposes. This was the first instream flow appropriation granted in Nebraska. Objectors argued that under the Nebraska state constitution, an “appropriation” required a physical diversion. The court said that, because of the water appropriation permit system, requiring a diversion as a prerequisite served no useful purpose.
