Quality Water Supply Inc. and Cape Fear Utilities were private utilities selling water to the public in New Hanover County. Landfall Associates was developing a subdivision, outside the corporate limits of Wilmington. Landfall requested and received permission from the city council to connect the subdivision to the city's water system. Quality and Cape Fear challenged the extension of service. The trial court ruled against the private utilities.
