In a dispute regarding rate increases by a municipally‐owned water utility without prior notification to customers, the City of West Tawakoni, Texas court of appeals ruled that the municipally‐owned utility was not a “utility” as defined by the Public Utility Regularity Act and was, therefore, not subject to the act's notice requirements. However, the utility was required to post the minutes of every meeting of its governing board for a minimum of 72 hours preceding the meeting time.
