Indianola Company asserted its claim to ownership of the water in Green Lake, which was formed by a natural depression, because it owns the land that the Lake is on therefore denying the jurisdiction of the Texas Water Commission. The trial and appellate courts decided in favor of the commission stating that when surface waters or flood waters come to rest permanently in a natural depression, they lose their characteristics as surface or flood waters and become the waters of a lake or pond.
