Refusal to Provide Water Not Discriminatory

The Sebring Utilities Commission (SUC) refused to provide water service to Home Savings Association (HSA), whose building was constructed outside city limits, unless HSA also purchased electricity from the commission. HSA refused this condition and installed a private well to supply its water needs. HSA then sued the commission claiming that its refusal to award water service without electricity was discriminatory. The trial court ruled for Home Savings but the appellate court reversed the decision, stating that the commission had not been discriminatory because it applied the same policy to all customers outside city limits.
