North Central Utilities Inc. (NCU) filed an action against the Walker Community Water System Inc, alleged to be a public entity, stating that NCU should have been awarded the contract for the construction job advertised by Walker because NCU entered the lowest bid. Law requires that public entities accept the lowest bid on a project. The court ruled that Walker is not a public entity and therefore did not have to accept the lowest bid on the project. NCU was not entitled to an award for the loss of profits and expenses.
