In a lawsuit brought by homeowners to prevent the construction of a sewage treatment plant, a South Carolina appellate court ruled that there was insufficient evidence to demonstrate an inevitable anticipatory nuisance. The use of property that does not create a nuisance cannot be enjoined merely because it lowers property values.
