A South Carolina appellate court ruled that a water storage tank constituted a “facility” and as such could not be constructed by a municipality on land within the service district of a county water and sewer authority. Under state law, no municipality operating a water system was allowed to extend its facilities beyond the corporate limits without prior approval of the authority.
