The plaintiffs in an Arizona lawsuit claimed that the state was negligent in allowing plant growth to continue in the Gila River, which caused the water from the river to be diverted onto their land. An appellate court ruled that the damage from the floodwaters was not the state's responsibility since the state had not cast the floodwaters upon the plaintiffs' properties by artificial means or by altering the natural watercourse.
