The Cane Creek Conservation Authority opposed the petition granted by the Environmental Management Commission to the Orange Water and Sewer Authority in North Carolina for the acquisition of land for the construction of a reservoir, arguing that the statewide effect of the project had been ignored and that too much emphasis had been placed on water quality. The Court of Appeals of North Carolina affirmed the Authority's certification, stating that the emphasis placed on water quality was appropriate and that the Commission had considered all the essential factors.
