After the Colorado Water Quality Control Commission levied a fine for discharge permit violations to the operators of a sand and gravel mine, a trial court upheld the commission's decision. An appeal, claiming that due process was denied because of use of evidence regarding inspections, was not upheld by the court. The court said that “Due process does not require that notice of inspections be provided after observations made by a private individual.”
