A municipal authority is liable for water escaping from its reservoir only if it failed to exercise care commensurate with the risk, rather than being absolutely liable, a Pennsylvania appellate court ruled. The principal cause of the leakage from the reservoir owned by the Municipal Water Authority of Westmoreland County was found to be caused by tunnels beneath the reservoir constructed during mining operations in the area.
