In 1978, the city of South Bend, Indiana, entered into an agreement with the South Bend Federal Savings and Loan Association for the lease‐purchase of a water system owned by the latter, which served the residents of River Commons, a subdivision outside the city limits. When the city wanted to install meters in the residences of River Commons, homeowners brought action, claiming that the city had no right to install meters. The trial court ruled for the city. An Indiana appellate court ruled that South Bend was within its rights to install meters in order to charge rates approved by the public service commission.
