The Supreme Court of New Hampshire reduced the assessed valuation of a water utility's property for $18 million to $6.2 million. The court disagreed with the use of a multiplier factor to determine the property's value and said that the concept of proportionality should be interpreted with reference to its historical use. For proportionality of tax burden to be achieved, the properties being compared must be assessed and taxed according to the same criteria, the court stated.
