The July 2016 American Bar Association Journal published an article reporting a significant increase in students requesting authorization to keep an emotional support assistance animal in campus housing. The Fair Housing Act obligates schools to consider such requests when an ESA is necessary to provide equal use and enjoyment of housing. Because ESAs are not service animals, and because the Americans with Disabilities Act regulates only the rights of individuals with service animals, the ADA service animal regulations, including the familiar two‐question rule, do not apply to student requests to keep ESAs in university housing.
