The plaintiff was a faculty member at California State University, Chico and served as the chair of the departmental personnel committee. The plaintiff completed a performance review for a tenure‐track professor, which disagreed with the committee's final evaluation. Accordingly, the plaintiff recorded her disagreements in a “minority report,” which was within her rights as a committee member.
