A notice of proposed rulemaking (NPRM) published Aug. 26 would allow law enforcement to have access to all patient records if it is investigating an alleged serious crime by one patient (see ADAW , Sept. 9). It would also change the definition of serious crime to include anything related to drugs. The NPRM, issued by the Substance Abuse and Mental Health Services Administration (SAMHSA), has a comment period closing Sept. 25 — a very short time frame.
