Grading the Discovery of New Methods Corrective Fiction: Could Europe Tear the Yellow Paper?

In this study, reasons behind the emergence of Supervised Independence System in Europe, which is actively implemented in Turkish Justice System in 20 July 2005, will be discussed. The most crucial reason is penalties of crimes are not only insufficient to rehabilitate criminals, but also have increasing and intensifying effects on crimes. It can be said that social novels embrace cultural, political, problems, social novels also include suggestions about solutions. In Les Miserables similar context reflects the social surroundings which is a fictional genre. All social groups have the behavior of tagging people who were sentenced before whatever crimes that those people committed. However they commit crime or they are leaved no choice, individuals are parts of social groups. They paid their mistakes by they were devoid of their freedom for a predetermined time. In Victor Hugo’s Les Miserables novel, the main character, who also had his share of tagging, tries to adept himself to social environment which he born in. It is wondering how social environment, government and institutions act in this process and at which direction they effect the character. Answers of these questions and answers of what should be will be tried to be given. In fact in today’s social environment, are attitudes toward the people who were punished before different? Bu çalışmada Türk Adalet sisteminde 20 Temmuz 2005 tarihinde aktif olarak uygulamaya konulan denetimli serbestlik sisteminin* Avrupa'da ortaya çıkış sürecini oluşturan sebeplerden bahsedilecektir. Bu sebeplerin başında kişilerin işlemiş olduğu suçlardan dolayı aldığı cezaların ıslah olmaktan öte suçu artırıcı ve pekiştirici olduğu gelmektedir. Topluma ait yaşamın her türlü kültürel birikimini içinde barındıran toplumsal, siyasal olaylar, inançlar, gelenek, görenekleri ile beraber bireylerin birbirlerine bakış açılarını da yansıtan tür diyebiliriz sosyal roman için. Bu tür kurguladığı sanal toplum ile günün sorununu yansıtırken çözüm önerisini de içerisinde barındırır. Sefiller’de de benzer bir soruna değinen bu ortam kurgusal bir tür olan romanın döneminin sosyal ortamını yansıtış biçimi ile ele alınacaktır. Hangi suç sebebi ile cezaevine girerse girsin bütün toplumlarda cezaevinden çıkan mahkûmu etiketleme davranışı vardır. Oysa kişiler suç işlemiş ya da suça itilmiş olsun bu toplumun birer parçasıdır. Ve belirlenen bir süre ile hürriyetten yoksun bırakılarak mağdur ve toplum vicdanına karşı bedel ödemişlerdir. Victor Hugo'nun Sefiller romanında da bu etiketlemeden nasibini almış olan kahraman, içinde doğduğu topluma yeniden adapte olmaya çalışmaktadır. Acaba toplum, devlet ve kurumlar bu süreçte nasıl rol oynamış ve bu kişiyi hangi yönde etkilemiştir. Bu soruların cevabı ve olması gerekenler cevaplandırılmaya çalışılacaktır.
