Unforgettable: a propósito de la STJUE de 13 de mayo de 2014. Caso Costeja (Google vs. AEPD) = Unforgettable: A purpose of the ECJ Case of 13. May 2014. Case Costeja (Google vs. AEPD)

Con fecha 13 de mayo de 2014 el TJUE se pronuncio sobre la interpretacion de la Directiva comunitaria de proteccion de datos con el fin de concluir si existia o no un derecho al olvido en Internet y sobre quien y como deberia hacerlo efectivo. El TJUE concluyo, por un lado, que existia un derecho al olvido en Internet como una de las facultades que integran el derecho fundamental a la proteccion de datos personales de los ciudadanos europeos (garantizado por el art. 8 CDFUE); y, por otro lado, concluyo que el responsable de hacerlo efectivo era el buscador en cuestion (en este caso, Google), independientemente de que la informacion en origen que habia sido indexada fuera o no suprimida por el editor original o de la pagina de origen, y siempre que los intereses o derechos del solicitante fueran dignos de proteccion y prevalecieran sobre cualquier otro interes o bien juridico en juego. On 13 May 2014 the ECJ ruled on the interpretation of EU Data Protection Directive in order to conclude whether or not there was a right to be forgotten on the Internet and who and how should make it effective. The ECJ concluded, first, that there was a right to be forgotten on the Internet as one of the faculties that integrate fundamental right to data protection of european citizens (as guaranteed by article 8 EUCFR); and, on the other hand, concluded that responsible for doing so effective was the search engine involved (in this case, Google), regardless of the information in origin that had been indexed, was or not removed by the original editor or the source page, and while the interest or rights of the applicant were worthy of protection and prevail over any other interest or legal right at stake.
