En la actualidad, el derecho a la proteccion sanitaria esta plenamente reconocido en la mayoria de los ordenamientos juridicos occidentales. Sin embargo, el derecho del paciente a rechazar un tratamiento medico sigue siendo un tema controvertido para la mayoria de los medicos y jueces, que de manera reiterada, priorizan jerarquicamente el derecho a la vida por encima de otros derechos, como la libertad para aceptar o rechazar un procedimiento medico (principio de autonomia), la libertad religiosa y la dignidad de la persona. La tendencia actual de los tribunales europeos es la despenalizacion del profesional de la salud que respeta la decision del paciente, aun cuando se cause un perjuicio considerable o incluso la muerte. En el Ecuador, la legislacion no es totalmente clara y precisa en este tema, por ello, estudiaremos la base juridica que dispone el paciente para rechazar un tratamiento medico por motivos ideologicos o religiosos en las Declaraciones, Pactos y Convenios internacionales. Presently, the right to health protection and provision is fully recognized in most western legal systems. However, the patient’s right to refuse medical treatment remains a controversial issue for most physicians and judges, who repeatedly prioritize the right to life above all else. Such doctors can accept or Refuse a medical procedure (principle of autonomy), religious freedom and dignity of a paitient. The European courts tend to side with the decriminalization of the health professionals who respect the patient’s decision, even if it causes considerable prejudice or even death. In Ecuador, the legislation is not totally clear and precise in this subject, therefore, we will study the legal basis that the patient has the right to refuse medical treatment for ideological or religious reasons in declarations, convenants, international agreement.
