La analogia entre juicio y arbitraje compromisario de tipo privado, trae su origen del Derecho Romano, y concretamente de un texto del jurista Paulo que cabe considerar como el punto de partida de la actual conformacion del arbitraje como «equivalente jurisdiccional». With regard to the formation of arbitration in the likeness of trial.Theanalogy between thetrial and theprivate compromisary arbitration has roots in the Roman Law. It appeared for the first time in a text written by the jurist Paulo which can be considered as the starting point of the current conception of arbitration as a jurisdictional equivalent.
