Educación sexual y derechos fundamentales : contribucióna un debate necesario

La Ley Organica 2/2010, de 3 de marzo, ademas de modificar la regulacion del aborto provocado en Espana, establece la incorporacion al sistema educativo, con caracter obligatorio, de la educacion en salud sexual y reproductiva. En el presente articulo, partiendo de la influencia del derecho internacional de los derechos humanos en el sistema constitucional de los Estados internacionalmente integrados, se analiza que estandars se derivan de la jurisprudencia del Tribunal Europeo de Derechos Humanos y del Comite Europeo de Derechos Sociales para una adecuada ponderacion del derecho a la proteccion de la salud y del derecho de los padres a decidir la formacion moral de sus hijos. La asuncion de estos estandars a la hora de regular el modo y contenido que debe adoptar la educacion para la salud sexual y reproductiva permitira que la inclusion de este tipo de educacion en el sistema educativo no genere nuevos conflictos, ayudando a alcanzar consensos en una cuestion que ha sido objeto de enfrentamientos en nuestra historia constitucional. Organic law 2/2010, of March the 3rd, apart from changing the abortion regulation in Spain introduced in the educational system compulsory education on reproductive and sexual health. This Article, starting from the influence of the international human rigths law in the Constitutional State, analyzes the legal standards derived from the European Court of Human Rights and the European Committtee of Social Rights case-law doctrine in order to achieve an adequate balance between the right to health protection and parent’s right to decide their children’s moral education. Asuming these standards when regulating the content of education for sexual and reproductive health and the way it should be introduced in Spanish schools will allow that these new educational reform do not create new conflicts, helping to reach consensus in an issue that has been a source of troubles in our constitutional history.
