A AUTORIDADE DA CONSTITUIÇÃO, INTERPRETAÇÃO E O PAPEL DO TRIBUNAL CONSTITUCIONAL: OUTRA PERSPECTIVA

O artigo trabalha a noção de autoridade nos sistemas de civil law, especialmente o brasileiro, destacando a inter-relação entre a noção de legitimação e a reivindicação da autoridade advinda de decisões proferidas por tribunais constitucionais. Como contraponto a essa realidade, apresenta-se a noção de autoridade nos sistemas de common law, que se difere daquela tanto na forma como encara a ideia de autoridade, tendo um viés mais construtivista, quanto no papel do uso de aspectos míticos na legitimação do poder. Para isso, apontam-se os conceitos romanos de auctoritas e potestas como influências fundamentais no moderno uso da autoridade, além de defender que o modelo de surgimento e transmissão de autoridade tem uma longa trajetória até ser transplantado para os atuais conjuntos normativos piramidais regidos por uma Carta Constitucional. Em seguida, enfoca-se o processo de superação do modelo clássico de transmissão de autoridade baseado no poder constituinte originário com aspectos metafísicos, tarefa essa que ainda não se realizou completamente no Brasil. Por fim, toma-se a obra de Joseph Raz, ressaltando a sua ideia de legitimação pela práxis (legitimação surgida no âmbito individual e orientada pela prática daquele que tenta se legitimar) como forma mais adequada de produzir a aceitação da autoridade reivindicada em um sistema político-jurídico.The article deals with the notion of authority in civil law systems, especially the Brazilian one, highlighting the inter-relationship between the notion of legitimacy and the claims of authority, arising out of constitutional courts’ decisions. As a counterpoint to this reality, we present the concept of authority in the common law systems, which differs from the former in its view of the idea of authority, especially considering his constructivist aspects, and the role of the use of mythical facets in power’s legitimation. In this sense, the article points to the Roman concepts of auctoritas and potestas as key influences in modern use of authority, defending that the appearance and the transmission model of authority have been modified in a long way until transplanted on the current pyramidal normative system governed by a Constitution. Then, we focus on the process of overcoming the model of authority transmission based on the constituent power, showing that its classical aspects are metaphysical, a task that has not yet been fulfilled in Brazil. Finally, we take Joseph Raz’s work, highlighting the influence of his idea of legitimization by praxis (legitimation founded by the individual choice and based on practices of whom tries to legitimate him or herself) as the most appropriate way to produce the acceptance of authority claimed in a political, legal system
