A Justiça Social de Amartya Sen aplicada à Liberdade de escolha para a Educação no Estado Social

This article is the result of the analysis of the State from the perspective of inequality and social justice understood by Amartya Sen, through a bibliographic research, correlating how they reflect, directly, in his conception of development as freedom. To illustrate the intended objective, it was sought, at first, to discuss the functions of a Social State, highlighting the importance of the theory of justice proposed by Amartya Sen, according to his approach of capabilities. The issue of social justice is at the heart of the theory of justice, as inequalities interfere in the development. In a second moment, the founding principles of Amartya Sen's capabilities was considered, highlighting that the capabilities are represented by a range of freedom of choice. Then, when developing Amartya Sen's conception of development, it was questioned whether his perception would fit into the brazilian Social State, making a contrast between interventionism and subsidiarity. Finally, and for illustrative purposes, it was decided to explore the freedom to choose the ideal education, opposing Amartya Sen’s idea, in order to discuss the aspects of individuality, defended by him, and collectivity. The analysis made comes from the constitutional choices by the State and its inclusive commitment.
